Snack Ambassadors Terms and Conditions, Property Access Authorization, Waiver of Liability, and Damage Limitation

These Terms and Conditions, Property Access Authorization, Waiver of Liability, and Damage Limitation Agreement are a binding agreement between the customer identified at checkout (“Customer,” “you,” or “your”) and Sean N Alex Productions, LLC, a Texas limited liability company doing business as (d/b/a) Snack Ambassadors, together with its owners, members, officers, directors, employees, contractors, agents, youth workers, family helpers, volunteers, affiliates, insurers, successors, and assigns (“Snack Ambassadors,” “Company,” “we,” “us,” or “our”). All references to “Snack Ambassadors” in this Agreement mean Sean N Alex Productions, LLC.

By checking the agreement box, submitting a reservation, making payment, clicking “Pay & Authorize Service,” or accepting any service from Snack Ambassadors, you agree to be legally bound by these Terms.

1. Services

Snack Ambassadors provides exterior trash can return, trash can relocation, trash can cleaning, scent application, sticker placement, and related exterior residential services. Services may include moving trash cans, recycling bins, compost bins, or similar containers from the curb, alley, street, driveway, sidewalk, or other pickup location back to the side of the home, garage area, storage area, gate area, fence line, or other exterior location designated by the Customer.

Services may also include cleaning trash cans using water, cleaning equipment, scent products, stickers, and related materials.

2. Exterior Property Access Authorization

You expressly authorize Snack Ambassadors and its operators to enter the exterior areas of the service property for the limited purpose of performing the selected services. This authorization includes, without limitation, permission to:

a. enter driveways, sidewalks, walkways, lawns, side yards, front yards, backyards, alleys, trash storage areas, exterior gate areas, and other exterior areas reasonably necessary to access, move, clean, or return trash cans;

b. open, unlock, pass through, close, and relock gates, fences, latches, and exterior access points using the access instructions, gate codes, keys, lockboxes, or other access methods provided or authorized by you;

c. move trash cans, recycling bins, compost bins, lids, and related containers;

d. use exterior water spigots, hoses, hose bibs, faucets, and related exterior water sources located at the property for trash can cleaning or related services;

e. park or temporarily place a golf cart, utility cart, bicycle, vehicle, trailer, wagon, cleaning equipment, hose, or service supplies in the driveway, curb area, alley, street area, or other exterior area reasonably necessary to perform the service;

f. place a Snack Ambassadors sticker, label, tag, or service marker on any cleaned trash can if cleaning service is purchased, accepted, or included; and

g. photograph or record the exterior trash cans, service area, gate, driveway, curb area, alley, or other exterior service area for proof of service, route verification, quality control, customer support, dispute defense, insurance, and business records.

Snack Ambassadors is not authorized to enter the interior of any home, garage, locked building, shed, or enclosed structure unless separately agreed in writing.

3. Customer Responsibility for Access and Conditions

You are solely responsible for providing accurate and complete service information, including pickup dates, service dates, address, gate codes, access instructions, trash can location, return location, number of cans, pet information, water availability, and any hazards or restrictions.

You are solely responsible for ensuring that:

a. gates, locks, latches, fences, hinges, wheels, trash cans, lids, driveways, walkways, hoses, spigots, and access areas are in safe and working condition;

b. pets are secured indoors or otherwise restrained away from the service area;

c. access paths are clear and reasonably safe;

d. Snack Ambassadors may lawfully access the exterior service area;

e. your HOA, landlord, municipality, or neighborhood rules allow the requested service;

f. exterior water may be used for cleaning if cleaning service is selected;

g. the trash cans are capable of being safely moved and cleaned; and

h. any gate code, lockbox code, access device, or special instruction provided by you is accurate and authorized.

Snack Ambassadors may refuse, delay, skip, or cancel service if the property appears unsafe, inaccessible, restricted, occupied by loose animals, blocked, poorly lit, or otherwise unsuitable for service.

4. Assumption of Risk

You understand and agree that exterior trash can return and cleaning services involve ordinary risks, including but not limited to scratches, dents, scuffs, stains, water marks, wheel marks, odors, spilled liquids, cleaning residue, broken trash can parts, gate or latch issues, driveway marks, landscaping contact, hose leaks, water usage, insects, animals, uneven surfaces, weather, low visibility, missed pickups, delayed municipal trash collection, and conditions outside Snack Ambassadors’ control.

You knowingly and voluntarily assume all risks associated with the requested services and exterior property access.

5. Conspicuous Waiver and Release of Liability

TO THE MAXIMUM EXTENT PERMITTED BY TEXAS LAW, CUSTOMER KNOWINGLY, VOLUNTARILY, AND EXPRESSLY RELEASES, WAIVES, ACQUITS, AND FOREVER DISCHARGES SNACK AMBASSADORS AND ITS OWNERS, MEMBERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, YOUTH WORKERS, FAMILY HELPERS, VOLUNTEERS, AFFILIATES, INSURERS, SUCCESSORS, AND ASSIGNS FROM ANY AND ALL CLAIMS, DEMANDS, DAMAGES, LOSSES, LIABILITIES, COSTS, EXPENSES, ACTIONS, CAUSES OF ACTION, OR SUITS OF ANY KIND, WHETHER KNOWN OR UNKNOWN, ARISING OUT OF OR RELATED TO THE SERVICES, PROPERTY ACCESS, TRASH CAN MOVEMENT, TRASH CAN CLEANING, WATER USE, GATE ACCESS, PARKING, STICKER PLACEMENT, OR ANY RELATED ACT OR OMISSION.

THIS RELEASE INCLUDES, WITHOUT LIMITATION, CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE, SOLE NEGLIGENCE, JOINT NEGLIGENCE, COMPARATIVE NEGLIGENCE, CONCURRENT NEGLIGENCE, OR OTHER FAULT OF SNACK AMBASSADORS OR ANY RELEASED PARTY.

THIS RELEASE APPLIES EVEN IF THE CLAIMED DAMAGE INVOLVES DAMAGE TO THE HOME, DRIVEWAY, GATE, FENCE, LOCK, LATCH, LANDSCAPING, GRASS, PLANTS, IRRIGATION, HOSE, SPIGOT, WATER LINE, TRASH CAN, RECYCLING BIN, COMPOST BIN, VEHICLE, PERSONAL PROPERTY, OR OTHER EXTERIOR PROPERTY.

Nothing in these Terms is intended to release liability for conduct that cannot be released under Texas law.

6. Damage Waiver

You agree that Snack Ambassadors is not responsible for damage, wear, tear, movement, malfunction, loss, theft, delay, or deterioration involving:

a. trash cans, lids, wheels, handles, hinges, axles, or serial numbers;

b. gates, locks, latches, hinges, fences, or access devices;

c. driveways, curbs, sidewalks, walkways, lawns, landscaping, irrigation, pavers, stones, siding, exterior walls, garage doors, or exterior surfaces;

d. water spigots, hoses, hose reels, hose bibs, faucets, nozzles, or water lines;

e. stains, residue, odors, scratches, dents, scuffs, spills, leaks, splash marks, tire marks, wheel marks, pressure marks, or cleaning-product effects;

f. HOA fines, municipal fines, missed trash collection, delayed trash collection, or cans not emptied by a municipal or private waste provider; or

g. any condition caused by inaccurate instructions, blocked access, unsafe conditions, pets, weather, third parties, municipal service providers, or pre-existing defects.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY TEXAS LAW, THE TOTAL AGGREGATE LIABILITY OF SNACK AMBASSADORS AND ALL RELEASED PARTIES FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICES, PROPERTY ACCESS, PAYMENT, RESERVATION, CLEANING, STICKER PLACEMENT, OR THESE TERMS SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY CUSTOMER FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

IF THE CLAIM RELATES TO A MONTHLY SUBSCRIPTION, THE MAXIMUM LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE SPECIFIC SERVICE VISIT GIVING RISE TO THE CLAIM, NOT THE TOTAL SUBSCRIPTION AMOUNT.

8. Exclusion of Certain Damages

TO THE MAXIMUM EXTENT PERMITTED BY TEXAS LAW, SNACK AMBASSADORS SHALL NOT BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL, EXEMPLARY, PUNITIVE, MULTIPLIED, LOST-USE, LOSS-OF-ENJOYMENT, LOSS-OF-SECURITY, EMOTIONAL-DISTRESS, INCONVENIENCE, DIMINUTION-IN-VALUE, REPLACEMENT-COST, LOST-PROFIT, BUSINESS-INTERRUPTION, OR SIMILAR DAMAGES, EVEN IF SNACK AMBASSADORS WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Liquidated Damages

Customer and Snack Ambassadors agree that actual damages from any alleged missed service, delayed service, incomplete service, access issue, cleaning issue, sticker issue, water use, or exterior property condition may be uncertain, difficult to prove, and disproportionate to the service fee. Therefore, to the maximum extent permitted by Texas law, Customer agrees that the sole and exclusive monetary remedy for any claim arising from the service shall be liquidated damages not exceeding the amount Customer actually paid for the specific service visit giving rise to the claim.

10. No Bailment or Custody

Snack Ambassadors does not accept legal custody, possession, control, or bailment of any trash can, recycling bin, compost bin, lid, personal property, gate, lock, access device, or other property. Any movement, cleaning, or handling of property is temporary and solely incidental to the selected service.

11. Water Use Authorization

If cleaning service is selected or provided, you authorize Snack Ambassadors to use exterior water available at the property. You are responsible for any water charges, water usage, leaks, hose defects, spigot defects, drainage issues, runoff, or related conditions. Snack Ambassadors is not responsible for increased water bills, hose failure, spigot failure, leaks, water pressure issues, or drainage issues unless caused by intentional misconduct.

12. Gate, Lock, and Access Authorization

If you provide a gate code, key, lockbox code, remote, latch instruction, or other access method, you represent that you are authorized to provide it and that Snack Ambassadors may use it. Snack Ambassadors is not responsible for a gate, lock, hinge, latch, fence, remote, or access device that malfunctions, fails to close, fails to lock, becomes misaligned, or was defective before, during, or after service.

13. Pets and Animals

You are responsible for securing pets and animals away from all service areas. Snack Ambassadors may skip or terminate service if any animal is loose, aggressive, unrestrained, or creates a perceived risk. You agree to indemnify Snack Ambassadors for any claim, injury, property damage, or third-party claim involving your pets or animals.

14. Parking Authorization

You authorize Snack Ambassadors and its operators to park or temporarily place a golf cart, utility cart, bicycle, vehicle, trailer, wagon, or equipment in the driveway, curb area, alley, street, or exterior area reasonably necessary to provide service. Snack Ambassadors is not responsible for driveway marks, tire marks, oil marks, scuffs, pressure marks, or similar conditions except to the extent caused by intentional misconduct.

15. Youth Operators and Helpers

Snack Ambassadors may use employees, contractors, family helpers, youth workers, supervised minors, or other authorized operators to perform services, subject to applicable law. Customer consents to such operators entering the exterior areas of the property for the limited purpose of performing the selected services.

16. Sticker Authorization

If trash can cleaning is purchased, accepted, or included, you authorize Snack Ambassadors to place a sticker, label, QR code, tag, or service marker on the cleaned trash can. Snack Ambassadors is not responsible for adhesive residue, fading, removal difficulty, HOA objections, municipal objections, or trash-provider objections related to sticker placement.

17. Photos and Proof of Service

You authorize Snack Ambassadors to take photographs or videos of exterior trash cans, the service area, gate, driveway, curb, alley, sidewalk, or other exterior areas for proof of service, quality control, customer support, dispute defense, insurance purposes, training, route verification, business records, and marketing. Snack Ambassadors will not intentionally photograph private interior living spaces.

18. Customer Indemnity

You agree to defend, indemnify, and hold harmless Snack Ambassadors and all released parties from and against any claims, damages, losses, liabilities, costs, expenses, attorney’s fees, or demands arising out of or related to:

a. inaccurate or incomplete service instructions;

b. unsafe or defective property conditions;

c. pets or animals;

d. gates, locks, fences, latches, hoses, spigots, water lines, trash cans, or access devices;

e. HOA rules, deed restrictions, landlord rules, municipal rules, or trash-provider rules;

f. third-party claims relating to property access or service;

g. your breach of these Terms; or

h. your failure to disclose hazards, restrictions, or access limitations.

19. Service Not Guaranteed

Snack Ambassadors will use commercially reasonable efforts to perform the selected services, but service is not guaranteed if access is blocked, unsafe, inaccurate, restricted, affected by weather, affected by municipal trash delays, affected by animals, affected by equipment issues, or otherwise impractical. Snack Ambassadors may reschedule, skip, refund, credit, or cancel service in its discretion.

19A. Porch Package Rescue — Limits and Liquidated Damages

PORCH PACKAGE RESCUE IS A CONVENIENCE SERVICE FOR LOW-VALUE ITEMS ONLY. BY SELECTING IT, CUSTOMER REPRESENTS THAT EACH PACKAGE WEIGHS 15 POUNDS OR LESS AND THAT THE TOTAL DECLARED VALUE OF ALL PACKAGES MOVED IN A SINGLE VISIT IS $15.00 OR LESS.

TO THE MAXIMUM EXTENT PERMITTED BY TEXAS LAW, THE SOLE AND EXCLUSIVE REMEDY FOR ANY CLAIM ARISING FROM THIS SERVICE — INCLUDING LOSS, THEFT, DAMAGE, DELAY, WEATHER EXPOSURE, OR MISPLACEMENT — IS LIQUIDATED DAMAGES NOT TO EXCEED $15.00, REGARDLESS OF THE ACTUAL VALUE OF THE ITEM.

CUSTOMER AGREES NOT TO USE THIS SERVICE FOR HIGH-VALUE, FRAGILE, PERISHABLE, TEMPERATURE-SENSITIVE, MEDICAL, OR IRREPLACEABLE ITEMS. SNACK AMBASSADORS IS NOT RESPONSIBLE FOR PACKAGES STOLEN OR DAMAGED BEFORE ARRIVAL, FOR CARRIER ERRORS, OR FOR ITEMS NEVER DELIVERED.

Packages are moved to exterior locations only (back patio, behind a gate, or a covered porch). Snack Ambassadors does not enter garages or any enclosed structure. A photograph of the drop-off location is taken as proof of placement, and delivery of that photograph completes the service.

19B. Cardboard Breakdown

Cardboard Breakdown covers flattening cardboard boxes and placing them in the Customer’s recycling container. Styrofoam, packing peanuts, plastic inserts, air pillows, and other non-cardboard packing material must be removed by the Customer before service. Boxes still containing such material may be left unprocessed at Snack Ambassadors’ discretion, and no refund is owed for boxes left for this reason.

Snack Ambassadors is not responsible for items accidentally left inside boxes, for recycling containers that are full or unavailable, or for a municipal or private hauler’s refusal to collect any material.

20. Payment and Subscription Terms

A reservation is not confirmed until payment is successfully completed. One-time services are charged at checkout. Monthly services may be charged on a recurring basis until canceled according to the cancellation policy shown at checkout.

21. Cancellation and Refunds

Snack Ambassadors may provide credits, refunds, or rescheduling in its discretion. Unless otherwise stated at checkout, missed services caused by inaccurate customer information, blocked access, unsafe conditions, loose pets, unavailable cans, unavailable water, or municipal pickup delays are not eligible for refund.

22. Electronic Signature and Consent

By checking the agreement box, submitting a reservation, making payment, clicking “Pay & Authorize Service,” or accepting services, you agree that your action is an electronic signature and legally binding acceptance of these Terms. You consent to electronic records and agree that the electronic version of these Terms has the same force and effect as a signed paper agreement.

23. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

24. Venue

To the maximum extent permitted by law, any dispute arising out of or related to these Terms, the services, property access, payment, or any reservation shall be brought exclusively in the state or federal courts located in Texas in the county where Snack Ambassadors maintains its principal office, unless a different venue is required by applicable law.

25. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect. Any unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving the intent of maximum protection for Snack Ambassadors.

26. Entire Agreement

These Terms, together with the checkout page, service description, and payment confirmation, form the entire agreement between Customer and Snack Ambassadors regarding the services.
